This Law stipulates the rights and freedoms of children in the Azerbaijan Republic, the main principles of state policy regarding children, the task of the state bodies and other legal and natural persons in protection of children in compliance with the Constitution of the Azerbaijan Republic, Convention on the Rights of the Child and other norms of international law.
Article 3. State policy regarding children
The state policy regarding children is focused on ensuring growth and development of each child in proper financial and life conditions, ensuring education based on progressive demands and child’s becoming a worthy citizen.
The state policy is implemented on the basis of special-purpose social programs for children developed in consideration of national and local conditions. Along with the state bodies, other legal and natural persons can also take part in the implementation of these programs.
Article 8. Child’s right to life and development
Each child has the right to life and physical, mental and moral development in normal conditions. The state takes the responsibility to implement the necessary economic, socio-legal and other measures and create a healthy and safe environment ensuring normal conditions.
Article 11. Child’s right to upbringing
Each child has the right to develop and receive upbringing in line with national and universal values, based on the principles of humaneness and morality. The child’s upbringing takes place in the family, at school, as well as at preschool and out-of-school educational institutions.
The state creates various facilities to develop children’s creativity and ensure aesthetic education, as well as assists the NGOs in creating such facilities.
It is forbidden to spread and demonstrate among children movies, literature and other means that propagandize violence and tyranny, erotic and pornographic materials harmful to children’s mentality and moral development, as well as involve children in making such products.
Article 44. Responsibility for the violation of this Law
The individuals guilty of violating this Law bear responsibility according to legislation.
Article 45. International agreements
In case of a contradiction between the international agreements, of which the Azerbaijan Republic is a part, and this Law, the international agreements are used.

Article 58. Parents’ rights and obligations regarding upbringing and education of children
58.2. Parents bear responsibility for their children’s upbringing, health and mental, physical and spiritual development.
Article 60. Exercise of parental rights
60.2. When exercising parental rights parents should not damage children’s spiritual development and their physical and mental health. When bringing up the children it is not allowed to exploit them, insult, humiliate their dignity, show cruelty, rudeness or indifference. The parents who infringe upon the children’s rights and interests when exercising their parental rights bear responsibility in the order prescribed by law.

154.1. Infringement of equality of citizens depending on race, nationalities, creeds, language, an origin, property or official position, belief, a belonging to political parties, trade unions and other public associations, with causing harm to rights and legitimate interests of citizens – is punished by fine of hundred up to five hundred of nominal financial unit or by corrective works for the term of up to one year.
154.2. The same action committed by official with use of the service position – is punished by fine of five hundred up to one thousand of nominal financial unit, or by corrective work for the term of up to two years, or with imprisonment for the term of up to two years with deprivation of the right to hold the certain position or to engage in the certain activities for the term of up to three years or without it.
Chapter 16
Article 101. Public appeals to implementation of aggressive war
101.1. Public appeals to implementation of aggressive war – shall be punished by restriction of freedom for the term up to three years or imprisonment on the same term.
101.2. The same acts accomplished with use of mass media or official – shall be punished by imprisonment for the term from two up to five years with deprivation of a right to hold a certain posts or to engage in the certain activities for the term up to three years or without it.
Article 109. Discrimination
Prosecution of any group or organization on political, racial, national, ethnic, cultural, religious motives, motives of a sexual belonging or on grounds of another motive forbidden by norms of international law, that is rough infringement of rights of people for a belonging to these groups or organizations, connected with other crimes against safety of mankind – shall be punished by imprisonment for the term of from five till ten years.
